“Sales life of a new design is a short one”

Dimock, District Judge.

“[P]laintiff’s business is a so-called style leader one for customers willing to pay for distinctive patterns and that the offering of the same patterns at lower and there at more popular prices robs plaintiffs’ goods of their distinctive appeal…. [S]ales life of a new design is a short one and that unless a preliminary injunction is issued pending the cases’ being reached for trial plaintiffs will suffer from defendant’s competition for substantially all the time that the design will have value.”

Peter Pan Fabrics, Inc. v. Brenda Fabrics, Inc., 169 F. Supp. 142, 143-44 (S.D.N.Y. 1959).
